Even if you have a prescription, you cannot use marijuana in public. Having a prescription may save you from being charged with possession but using is a separate charge.  You can only use medicinal cannabis products, that you have a prescription for and have legally accessed within your own home or private property. Public use of cannabis in Queensland may lead to fines or other more severe penalties depending on other surrounding circumstances.

It is illegal to drive if you are using marijuana as a medical treatment. Driving whilst you are using a medicinal marijuana product that contains the THC cannabinoid means you put yourself and others at risk. THC can last in your system for hours and its effect may reach its peak hours after you have used the drug, depending on the administration method. THC can also be found in your saliva 12 hours after use, and 30 days in your urine if you are a heavy user.

Growing Cannabis in Queensland

Growing weed in Queensland is prohibited. There is a licensing scheme that can be applied for that can allow a person to produce cannabis for medicinal purposes, but a person or company must be able to properly secure the cannabis and meet other requirements. In all other instances, section 8 of the Drugs Misuse Act 1986 states that the production of a dangerous drug, cannabis included, is illegal.

If you are found to be cultivating less than 500 grams (or 100 plants) of cannabis, you could face up to 15 years imprisonment. Any more than that and the maximum penalty increases to 20 years.

If you want to have legal access to cannabis in Queensland the only way is through the Therapeutic Goods Administration (TGA). You would have to visit a doctor and have a discussion on whether medical marijuana is an appropriate treatment option. This consultation will include cautions such as the risks of driving whilst being treated with a THC product and the many potential negative side effects which may include:

  • Vertigo
  • Fever
  • Depression
  • Dry mouth
  • Eye irritation
  • Memory impairment

Once you can make an informed decision on the use of medicinal cannabis as a treatment option, the doctor will begin the process of applying for the TGA’s approval. The doctor may not need to apply for approval if they have already been registered as an Authorised Prescriber.

If you are caught with medicinal cannabis, an inspector or police officer will be able to confirm that you have legally sourced your marijuana from the label or by contacting the pharmacy and prescriber.

Possessing weed in Queensland is illegal. The consequences of being caught in possession of weed will vary according to the amount you are caught with and the circumstances surrounding the offence and charge. There may not be any penalty if an officer or inspector can determine that marijuana in your possession is medicinal and legally accessed.
