Possessing cannabis in Victoria is a chargeable offence. If you are only in possession of an amount of marijuana that is less than 50 grams, then the police informant/charging officer can decide to give a warning. There could be a separate charge for the use of marijuana. You could be charged for the use of cannabis if an officer has caught you smoking, inhaling fumes or using any cannabis product.

If you have disclosed that you have used cannabis, you may also be charged. This disclosure should be written into the “details of charge” in your charge sheet which will be seen by the magistrate assigned to your Court case.

The severity of your charge and the resulting consequences will vary on the circumstance of your charge and the amount of cannabis in your possession.  Legally a small amount of cannabis in Victoria is defined as less than 50 grams. You may be charged with drug trafficking if you are caught with 250 grams or over of weed. Growing 10 cannabis plants is also considered possessing a trafficable amount of weed. Being caught trafficking marijuana will mean legal action and will require the assistance of a lawyer. Preparing or selling cannabis are also drug trafficking offences. Any doctor or nurse can apply to the TGA on behalf of a patient for the Special Access Scheme (SAS). Most forms of cannabis are unapproved by the TGA and thus can only be accessed through SAS. There are a couple of approved products such as nabiximols from the brand Sativex® which is used to treat muscle spasticity in persons with Multiple Sclerosis. An approved product that is on the TGA’s Australian Register of Therapeutic Goods (ARTG) would not need SAS approval to be prescribed.

If a doctor is registered as an Authorised Prescriber (AP), they can prescribe medical marijuana to multiple patients without having to fill out a SAS application for each patient. Before a nurse, doctor or an AP can assist you in getting legal access to medicinal cannabis they will discuss with you that the research of cannabis as a medical treatment is still ongoing and will give you a list of potential side effects of using marijuana which may include:

  • Confusion
  • Fatigue
  • Dry mouth
  • Memory impairment
  • Dizziness
  • Sweating
  • Heart palpitations
  • Diarrhoea

The side effects of medical marijuana may differ with each user and so will the severity. These side effects are also influenced by the amount of the active ingredients THC and CBD. As of February 28, 2022, the Victorian Department of Health does not require prescribers to have a Schedule 8 treatment permit to prescribe medicinal cannabis to a patient. They will still need to have approval from the TGA before a prescription can be written. The prescriber will also need to check the patient’s prescription history through SafeScript before prescribing medical marijuana. 

A permit to prescribe a Schedule 8 is required when the patient has had a history of drug dependence. No exceptions for this permit may apply to a drug-dependent patient.
